Adore Your Outdoors Terms and Conditions v4 June 2023

Terms of Payment
 

  1. The following Terms of Payment (‘TOP’) apply to services and training courses offered by Adore Your Outdoors represented by Sonya Dibbin.
  2. For the purposes of these TOP, a reference to ‘we’, ‘us’, ‘our(s)’ shall mean Adore Your Outdoors, and a reference to ‘you’, ‘your(s)’ shall mean the end client who receives our services.
  3. For the purposes of these TOP, Adore Your Outdoors and you shall be collectively referred to as ‘the Parties’, and individually as ‘a Party’
  4. We offer a variety of services, the prices of which are listed on our website. While prices on our website are listed as accurately as possible, please note that:

a) currently we are not required to be registered for VAT. Should this change necessary updates will be made to our prices on the website, or where we have not been able to update the website, you will be notified at the earliest possible time.

b) for private or bespoke sessions, travel costs @ 45p /mile for the first 10,000 miles and thereafter 25p/mile will be added if the location is further than a 30-minute drive.

c) we use third-party payment gateways such as PayPal and Stripe to help facilitate client payments should you purchase or sign up for any of our services via our website. Third-party payment gateways may charge you a transaction fee over which we have no control. We do not benefit from such transaction fees.

 

  1. We offer payment plans for some of our services, such as training courses. If you are on a payment plan you agree:

a) to adhere to, and to be legally bound by all the terms and conditions of the payment plan that we have shared with you, verbally or in writing (writing includes via email).

b) to make timely payments, i.e., all payments must made on or before the due date(s) specified in your payment plan.

c) that any delay in payment(s) shall entitle us to suspend the provision of our services to you until outstanding payments due to date have been paid in full.

d) that where the delay in payment continues for more than 7 (seven) calendar days from the due date, in addition to suspending the provision of our services to you, we shall be entitled to charge a late payment fee at 5% of the outstanding amount for each day of default.

e) that where we have concluded the provision of services to you, you shall still continue to make timely payments of outstanding amounts in accordance with the terms of your payment plan. In case of a delay or default in payment where such delay or default continues for more than 7 (seven) calendar days from the due date, we shall be entitled to:

  1. charge you a late payment fee at 5% of the outstanding amount for each day of default.
  2. authorise a debt collection agency to collect all outstanding payments from you including the late payment fee that may have accrued.

f) By opting for a payment plan you agree for us to process and share your personal data with third parties, including without limitation debt collection agencies.

 

  1. Prices for private events and sessions will reflect the specifics of the agreement signed by the Parties. Payment can either be made in full by way of a bank transfer the details of which shall be printed on your invoice, or by way of a payment plan in which case the provisions of paragraph 5 of these TOP shall apply. Where you wish to make full payment by way of a single transaction, the payment must be made within 30 (thirty) calendar days from the date on which the invoice is issued (‘Invoice Date’)

 

  1. Prices for employee well-being programmes will reflect the specifics of the Agreement signed by the Parties. Payment can either be made in full by way of a bank transfer the details of which shall be printed on your invoice, or by way of a payment plan in which case the provisions of paragraph 5 of these TOP shall apply. Where you wish to make full payment by way of a single transaction, the payment must be made within 30 (thirty) calendar days from the Invoice Date

 

  1. Gift vouchers must be used within 12 (twelve) months of purchase. Should you wish to purchase or sign up for a service, the value of which exceeds the value of the gift voucher, you agree to pay the additional difference in price. This difference in price can be paid via third party payment gateways or by way of a bank transfer. 9. Offer codes run for certain validity periods and cannot be used outside of those periods.

 

  1. Usually, sessions need 4 people booked on to go ahead. If there are fewer than 4, I might rearrange the session and will do this with agreement from all participants where I can.

 

  1. We may at our discretion provide concessions to NHS workers and teachers. Providing a concession for one group of persons or for a particular service does not legally bind us to continue offering the same concession in future and/ or to provide the same or similar concessions to other clients and/or in respect of other services.

 

  1. Rescheduling and Cancellation Policy: You may reschedule a forest bathing session at an admin fee of £5 up to the date of the originally scheduled session. Rescheduling requests made after the session or event has concluded will unfortunately not be considered, and the session will be deemed forfeited. No refund will be available in such circumstances.

 

Our forest bathing session cancellation policy is as follows:

 

  1. If you cancel 8 (eight) days before a session, you may reschedule in accordance with our rescheduling policy above, or request for a full refund.
  2. If you cancel 3-7 inclusive days before a session, you may reschedule in accordance with our rescheduling policy or receive a 50% refund.
  3. If you cancel 0-2 inclusive days before a session, you may reschedule in accordance with our rescheduling policy, but no refund shall be available.

 

Please allow us up to 14 days to process refunds.

 

  1. If we need to change the location of a session due to forestry operations communicated by landowners/managers at short notice you will be able to attend at the replacement venue. Alternatively, you will be given credit enabling you to attend any other session of equivalent value at any time within 6 (six) months from the date on which the original session was scheduled to take place. Unfortunately, since situations like these are outside of our control, no refund is available.

 

  1. Sometimes we may have to cancel a session due to weather conditions in which case you will be given credit enabling you to attend any other session of equivalent value at any time within 6 (six) months from the date on which the original session was scheduled to take place. Unfortunately, since situations like these are outside of our control, no refund is available. If the weather turns unexpectedly bad during a session, the walk might be shorter than initially planned and unfortunately no refunds are possible since situations like these are outside of our control.

 

  1. I reserve the right to cancel a session if there are only males booked on, for personal safety reasons. In this scenario, a full refund will be given.
  2. No refunds are available in case of a no show, i.e., if you fail to attend a session that you had already booked and paid for, but which was not cancelled or rescheduled in accordance with these TOP.

 

Customer Responsibility
It is the customer’s responsibility to use their own judgement about attending a booked session if feeling poorly, to declare any medical conditions and bring their meds.
They will also bring suitable, adequate clothing, this includes extra layers and waterproofs or sun lotion, hat and insect repellent.
Participants will respect the forest by not leaving any trace of their visit and doing no harm to anything on any Forest Therapy walk.

 

My Responsibility
Adore Your Outdoors is insured and has public liability insurance of £5million.
I am first aid qualified – outdoor first aid and mental health first aid. 
I conduct risk assessments at all sites and do a pre-walk routine on the morning of the walk to check the route is safe.

 

Complaints procedure
If you are unhappy with the service received from Adore Your Outdoors, please email details of the situation to sonya@adoreyouroutdoors.co.uk where it will be properly investigated.

Under the GDPR we use the consent lawful basis for anyone subscribing to our newsletter or marketing mailing list. We only collect certain data about you, as detailed in the "What information we collect about you" above. Any email marketing messages we send are done so through an EMS, email marketing service provider. An EMS is a third-party service provider of software / applications that allows marketers to send out email marketing campaigns to a list of users.
Email marketing messages that we send may contain tracking beacons / tracked clickable links or similar server technologies in order to track subscriber activity within email marketing messages. Where used, such marketing messages may record a range of data such as; times, dates, I.P addresses, opens, clicks, forwards, geographic and demographic data.
